Terms of Service Agreement

This Terms of Service Agreement ("Agreement") is a legally binding contract between ATimeHost ("Company," "we," "us," or "our") and the individual or entity ("Client," "you," or "your") who registers for or uses our web hosting services ("Services").

By using our Services, you agree to be bound by the terms herein.

1. Description of Services

We agree to provide web hosting, domain registration, and related technical services as specified in the service plan selected by the Client during checkout.

2. Account Eligibility and Security

• Accuracy: You must provide accurate, current, and complete information during registration.
• Security: You are solely responsible for maintaining the confidentiality of your login credentials. Any activity under your account is your responsibility.
• Verification: We reserve the right to request identity verification to prevent fraudulent use of our resources.

3. Acceptable Use Policy (AUP)

The Services must be used for lawful purposes only. Prohibited activities include, but are not limited to:

• Illegal Content: Hosting or transmitting any material that violates local, state, or international laws (e.g., child pornography, copyrighted material without consent).
• System Abuse: Excessive resource usage (CPU, RAM, or Disk I/O) that negatively impacts other clients on shared infrastructure.
• Malicious Activity: Distributing malware, phishing, or participating in DDoS attacks.
• Spam: Sending unsolicited bulk email (SPAM) is strictly prohibited and will result in immediate termination.

4. Service Level Agreement (SLA) and Uptime

• Uptime Guarantee: We aim for a 99.9% network uptime.
• Maintenance: Scheduled maintenance will occur during off-peak hours with at least 24 hours' notice.
• Exclusions: Downtime caused by Client-side issues, third-party software, or Force Majeure events is excluded from SLA credits.

5. Billing and Payments

• Fees: Fees are billed in advance based on the billing cycle selected (Monthly/Annual).
• Refunds: We offer a 7-day money-back guarantee for new hosting accounts. Domain registrations and SSL certificates are non-refundable.
• Late Payments: Failure to pay within 7 days of the invoice due date may lead to service suspension. Data may be deleted 7 days after suspension for non-payment.

6. Data Protection and Privacy

• Compliance: We process data in accordance with our Privacy Policy and applicable laws, including GDPR and CCPA.
• Backups: While we perform regular backups for disaster recovery, the Client is ultimately responsible for maintaining independent copies of their data. We are not liable for data loss.
• DPA: If you are a business subject to GDPR, our Data Processing Addendum (DPA) is incorporated into these terms by reference.

7. Limitation of Liability

To the maximum extent permitted by law, ATimeHost shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising out of the use or inability to use the Services. Our total liability shall not exceed the amount paid by the Client for the Services in the three (3) months preceding the claim.

8. Term and Termination

• Client Termination: You may cancel your service at any time via the Client Portal.
• Company Termination: We reserve the right to suspend or terminate your account immediately for violations of the AUP or non-payment.

9. Governing Law

This Agreement shall be governed by the laws of Thailand, without regard to its conflict of law principles.

10. Modifications

We may update these terms periodically. Continued use of the Services after such changes constitutes your acceptance of the new terms.
